Harmonisation of Motor Third Party Liability Insurance in compliance with EC Law

Harmonisation of Motor Third Party Liability Insurance in compliance with EC Law Motor Third Party Liability Insurance is recently facing major changes, not only from EC point of view, but from national perspective as well, mainly due to technological development as well as due to the enormous pressure set on vehicles accident victims protection, ie. their appropriate compensation from Motor Third Part Liability (further known as MTPL) cover. Main consequence of above mentioned fact is a clear definition of the vehicle that falls under the obligation of MTPL. However just the simple extension of the vehicle definition that way, that even escooters and sagways fall under the scope, would not be considered as a sufficient measure taken to sort of eliminate the number of severe claims and bodily injuries caused by these vehicles in most of the EC states. It is more than necessary that every single member state will come with substantial measures on national level to sort of regulate on legal basis the traffic rules of these new kind of vehicles. However, it is currently obvious that member states opinions are far from any common decision on this topic concerning measures to decrease the number of claims and furthermore to restrict the use of these vehicles in respective environment. Motor Third Party Liability in the European Context

MTPL insurance represents a complex issue regulating in particular protection of the third party in a claim settlement. This area is regulated on the EU law level by Council Regulations and Motor Insurance Directives as well by the green cards system and Hague Convention on the Law applicable to traffic accidents on the international level. To provide MTPL insurance in the European Union is possible under the single European passport but there are still persisting the differences in the extent of insurance cover and liability in the particular Member States including the national regulation requirements. The primary condition for MTPL insurance providing in the EU/EEA is the obligatory membership of the insurer in the national Insurers' Bureau and the Guarantee Fund. The Court of Justice of the European Union relevant decisions has contributed to the interpretation of Motor Insurance Directives provisions and to determination of their correlation to national legislations. From the future perspective is of the importance the legislation process of the PEICL draft. The Czech legislation is fully in compliance with the EU law. Car Insurance

The aim of this thesis is to describe the car insurance in the Czech republic. The car insurance consists of two major areas, the liability insurance of vehicle and the accident insurance. This thesis enables the reader to understand the pricipal aspects of car insurance and their interactions. In the first part is explained the liability insurance of vehicle which is required for all motor vehicles. The second part is focused on the voluntary accident insurance and additional accident insurance products. In the last part of the thesis are compared offers from individual insurance companies based on inquiries from two model applicants with the selection of the optimal product for each applicant based on their different conditions and life situation.

The bachelor thesis deals with the impact of the new Civil Code on the Czech market of the MTPL Insurance (Motor Third Party Liability Insurance). The theoretical part is focused on the definition of risk, on the principles of functioning of insurance and the changes that the new Civil Code brings. In the practical part are identified key players in the MTPL Insurance market at first, also is described the development of the market before and after the beginning of 2014 and based on this is then evaluated the impact of the new Civil Code on the MTPL Insurance market.

Analýza pojištění odpovědnosti za škodu způsobenou provozem vozidla na českém pojistném trhu

Práce se zabývá trhem pojištění odpovědnosti z provozu vozidla v České republice. Věnuje se nejprve současné právní úpravě tohoto druhu pojištění a vysvětluje základní pojmy důležité pro jeho pochopení. Obsahuje popis poptávky na trhu, včetně nehodovosti na veřejně přístupných komunikacích. Zabývá se současnými nabídkami na trhu, včetně jejich porovnání na konkrétních případech. Hodnotí je a vymezuje kritéria z klientského hlediska důležitá pro výběr nejvhodnější pojišťovny. Na závěr shrnuje získané poznatky.
